Terms of Use

Greg Hoxsie Real Estate Photography retains the full ownership and Copyright on any photographic, video, 3d scans, floor plans and related content we may provide as a part of our San Diego Real Estate Photography services. Most of the content we provide is subject to a limited use license that generally allows our clients exclusive use of the images, video etc., for the purposes of marketing an active San Diego real estate listing on MLS services for the period of the listing. Our San Diego real estate photography content is not transferrable to a third party without our written consent nor can the content be resold or used in any way by another realtor for any purpose unless we have provided some kind of authorization in writing. A Terms of Use document is included with every download of content provided by Greg Hoxsie Photography. There is a separate Terms of Use document for short and long term rentals. Our clients can use any of the listing content we have provided for their own advertising and marketing purposes in printed or electronic media such as social media or printed brochures for a period of 5 years. This content may NOT be used by the Buyer's Agent or ANY THIRD PARTY without the written permission of Greg Hoxsie Photography. For the record, it's not OK to screenshot random images on the internet or from the MLS and then use them in your San Diego Real Estate listings without prior approval from whoever has the Copyright on the image. That's usually the photographer. Doing so opens the door to expensive legal consequences and possible fines from various MLS services. Real Estate Listing Image Rights and Limited Use License: Greg Hoxsie Photography maintains ownership and Copyright of all delivered content including but not limited to images, video, floor plans and 3D scans. A Limited Use License is granted to the listing agent(s) ordering the services for the period of the listing for the purposes of advertising the listing on various MLS and syndicated services and in printed and electronic media. The same listing content may be used by the original agent(s) ordering the services for self promotional purposes in printed or electronic media for a period of 5 years. Images and related content may not be used by, transferred to, or sold to any third party, including other realtors, without the written permission of Greg Hoxsie Real Estate Photography.

Altering Image and Video Files: Image files may be altered and virtually staged at the discretion of the listing agent. However, video files may not be altered, reformatted, or re-edited by any third party without our written permission.

Billing and Payment: Payment in full is required upon receipt of invoice after the delivery of the images. Credit card payments and bank transfers are gladly accepted. Job quotations are estimates. Final billing will reflect the amount of work and/or special requests calculated after the job is completed.

Cancellation Policy: There is no penalty for cancellation with 24 hours notice. For cancellations within the 24 hour window, you will be charged $210 (our minimum charge) unless the cancellation is weather related.

Archival of Digital Content: Most images are archived indefinitely. Retrieval of archived images may incur extra charges. Virtual tours are hosted for 6 months only. Long term hosting is available for $120 per year. Most edited video files are backed up indefinitely. The minimum editing fee of $75 is charged for the retrieval of older video files.

Scope of Work: We will need detailed instructions on the exact areas you want photographed. This might include amenities such as pools, spas, gyms, bbq areas, meeting rooms, lobbies, laundry rooms, common areas, nearby attractions, tennis courts, parks, playgrounds, etc. We cannot photograph other people without a model release. For example, we cannot shoot random people in common areas without their express written permission. Pricing may be adjusted for requests made at the shoot that go beyond what was originally quoted. Personal or staff portraits are not included in our pricing for real estate photography and are quoted separately.

Property Access: In the event we cannot gain access to the property for any reason OR if the property is not fully prepared at the agreed upon date and time, you will be billed for the full amount of the services ordered. Late start fees may apply if the property is not available at the agreed upon time and place.

Turnaround: We offer next day delivery on most services. Video can take 24-72 hours to edit.

Acts of God: We cannot be held responsible due to unforeseen circumstances not in our control that include but are not limited to: Traffic delays, road closures, mechanical failures, construction issues or delays, medical or family emergencies, weather, internet outages, etc. We will contact you at our earliest convenience to reschedule if it becomes apparent that we will be delayed for any reason.
