FAQs
San Diego Real Estate Photography Frequently Asked Questions
What is your cancellation policy?
Cancellations or reschedules need to take place 24 hours prior to the scheduled time of the shoot. Any cancellations or reschedules taking place within the 24 hour window are assessed a cancellation fee of $210 per photographer involved with the shoot. Cancellation or reschedule terms and fees for larger homes are included in any quotes or estimates prior to the shoot.
What are the Terms of Use and who owns the content you provide?
Greg Hoxsie Photography maintains ownership and Copyright of all delivered content including but not limited to images, video, floor plans and 3D scans. A Limited Use License is granted to the listing agent(s) ordering the services for the period of the listing for the purposes of advertising the listing on various MLS and syndicated services and in printed and electronic media. The same listing content may be used by the original agent(s) ordering the services for self promotional purposes in printed or electronic media for a period of 5 years. Images and related content may not be used by, transferred to, or sold to any third party, including other realtors, without the written permission of Greg Hoxsie Real Estate Photography.
Can I copy older images from the MLS and use them in my NEW listing of the same property?
The short answer is NO unless you have received written permission from the Copyright holder which is usually the photographer. Copying images from the internet and using them without permission for commercial purposes opens the door to Copyright Infringement claims. Plus, it's in violation of the rules you have accepted in your agreement with the MLS. Every MLS service has its own rules, but here's how Section 11.5 reads for SDMLS: Participants and subscribers shall not have the right to and shall not use, reproduce, display or distribute Media from the MLS unless and until he or she obtains written authorization from the party with the legal right to grant permission to do so.
